This sounds innocent, but they’re hoping you’ll say something that makes it your fault. Keep your answer short. Just explain where you were, where you were going, and what you saw. Don’t guess or say anything like "I feel bad" or "I was tired."
2. "Were you hurt?" or "How are you feeling?"
If you say, "I'm fine," they may use that to say you weren’t really hurt. It’s better to say, "I’m still being evaluated by my doctor."
3. "Everyone gets distracted sometimes, right?"
This is a trick to get you to admit fault. Don’t agree. Just say, "I was paying attention to the road."
4. Questions about your health history
If they ask about conditions like arthritis or old injuries, they're trying to blame your pain on something else, like a pre-existing condition. You can say, "That’s not relevant to my claim," or tell them to talk to your lawyer.
5. "Can we record your statement?"
Don’t do it. A recorded statement can be used against you. You're not required to give one to the other driver’s insurance. Always talk to a lawyer first.
