My client is a 41-year old father of two. He was employed as a laboratory technician at an oil refinery. He was diagnosed with fibromyalgia, depression and anxiety. Prior to applying for disability through his company’s long-term disability insurance, he had suffered through work for about three years while battling his ailments. When the pain, fatigue and cognitive issues became to much to handle, he had no choice but to utilize the benefits available to him through his company’s benefits package.He sought my services when the insurer denied his application.After obtaining his claim file and reviewing the policy of insurance applicable to his claim from CIGNA, we filed an administrative appeal of the insurer’s decision focusing on well documented and supported non-exertional limitations the client experienced. The appeal also noted CIGNA’s lack of medical opinions refuting these non-exertional limitations.
CIGNA then requested an insurance medical examination by both a psychologist and a physical medicine physician. We prepared the client extensively for what to expect at these examinations.
After submitting the appeal and the insurance medical examination reports, CIGNA overturned its decision and reinstated benefits. The potential lifetime value of the client’s benefits exceeds $500,000.
