My client from Marrero, LA with a 30-plus year work history as a building engineer in downtown New Orleans buildings requested help when he was denied Social Security Disability benefits following a partial kidney removal.The claimant’s occupation required extensive physical activity including walking up and down numerous flights of stairs, lifting and carrying large cooling units and motors, and keeping a regular maintenance schedule. While he recovered some ability after the partial kidney removal, he fatigued easily, could not lift as much weight as before, and began to experience significant pain at the removal site.On top of that, he had been having shoulder issues for a while but put off treatment because he could not afford to miss work. When he finally sought treatment, he was informed that he had a significant tear and would need surgery to repair and at least one-year to recover. His recovery went well, but he could never fully regain the strength, range of motion, and ability he had in the shoulder prior to the injury.At the claimant’s hearing, we focused on his exemplary work history, his significant earnings, and his ongoing care and treatment. Since his prior occupations were physically demanding, we were able to convince the judge that he was unable to perform those and that while he retained some ability to work, it was limited to light work only. The judge agreed and awarded benefits.This client dutifully paid his taxes each pay check to ensure that disability benefits would be available if he ever needed them. I took great pride in helping him convince the government to honor its obligation. This client will receive almost $175,000 in benefits plus Medicare.
