Browsing clothing racks was enjoyable until 64-year-old Debra stepped on an anti-theft sensor in a store inside the biggest and busiest mall in Metairie.
The sensor had a needle-like prong sticking out of one side and ended up stuck in Debra’s shoe. As she felt the sensor on the bottom of her shoe, she slipped and twisted her right knee. Her knee instantly hurt and began swelling.
Retaining us days after the incident, we diligently built her case proving the store’s negligence and tying her knee injuries directly to the incident.
Through discovery, we uncovered a store in chaos. Procedures not being followed, and walkways not clear for shoppers to safely traverse. It was a situation waiting for a victim, and unfortunately for Debra, it was her.
An MRI showed tears in the meniscus and cartilage of the right knee and bulging discs at C2-C3, C3-C4, C4-C5, C5-C6, and C6-C7. She received medical treatment and therapy for the injuries. Doctors also recommended her for surgery, but due to her age and pre-existing conditions, she was never cleared for surgery and is forced to live with the pain.
During the case, the store declared bankruptcy, forcing our Metairie slip and fall lawyers to navigate the complexities of bankruptcy law to ensure Debra’s claim was not lost.
Ultimately, we were able to remove the case from the bankruptcy proceedings and move forward fighting for Debra. After more discovery, we secured a six-figure settlement for Debra, representing the mental and physical suffering she faced and continues to face.
