My client was a 69-year-old semi-retired school bus driver. While in her personal vehicle she was hit by an inattentive motorist who ran a red light at a major intersection. The offender was driving her daughter’s vehicle.The collision caused the emergency brake pedal to lodge into my client’s leg resulting in a significant hematoma. My client sought treatment from her general physician who recommended monitoring the injury. When the hematoma remained after multiple visits, surgical debridement was necessary. The surgery was performed under general anesthesia. The client continues to suffer with some residual pain at the hematoma site and her doctor indicated there is no time table for its complete healing.My office filed a claim with the driver’s insurer, the owner of the car’s insurer and my client’s own underinsured motorist coverage. Settlements were reached with all insurers for policy limits on each coverage. In total, the client settled for $45,000.
