Until December 31, 2025: Louisiana uses pure comparative fault. You can still recover compensation even if you were mostly at fault, but your recovery is reduced by your percentage of fault.
Starting January 1, 2026: Louisiana law will change to a modified comparative fault system. If you are found 51 percent or more at fault, you cannot recover damages.
